AMR – Pleading Update 1/11/2012 – Bankruptcy

Withdrawal of Limited Objection of U.S. Bank Trust National Association to Section 1110 Election

U.S. Bank Trust National Association (“U.S. Bank”), as trustee, recently withdrew its limited objection to the Debtors’ election pursuant to section 1100(a) of the Bankruptcy Code with respect to American Airlines 2009-1A EETC Aircraft Equipment because U.S. Bank received the scheduled payment from the Debtors on January 3, 2012.

Limited Objection of HSH Nordbank to Section 1110 Election

HSH Nordbank, AG (“HSH Nordbank”), individually and as agent for itself and other lenders, filed a limited objection to the Debtors’ election pursuant to section 1100(a) of the Bankruptcy Code with respect to aircraft bearing the following registration numbers: N943AN, N928AN, and N783AN.  According to the objection, HSH Nordbank is the original lender under the terms of certain loan agreements with American Airlines, Inc.  On December 30, 2011, American Airlines Inc. filed its Notice of Election Pursuant to Section 1110(a) of the Bankruptcy Code with Respect to N943AN, N928AN and N783AN (the “Election”).

HSH Nordbank asserts that it filed the limited objection to the Election with respect to the cure amounts listed in the Election for N928AN and N943AN for the sole purpose of assuring timely compliance with the Section 1110 Order.  HSH Nordbank alleges that the cure amounts set forth in the Notice of Election in respect of N928AN and N943AN are incorrect. The cure amount set forth in the Notice of Election for N928AN is $1,449,976.97. HSH Nordbank believes that it and the Debtors now have agreed that the proper cure amount for N928AN is $1,450,158.50.  Moreover, the cure amount set forth in the Notice of Election for N943AN is $1,746,708.23, but the proper cure amount is $1,746,874.49.
