Below is a list of some of those bills and their status the Oklahoma AFL-CIO is tracking. The legislature has begun to hit deadlines, starting this week in the Senate. This deadline has left some bills DEAD and will be removed from this list next week. The bills that are have had changes sense the last Legislative Update.House Bill 1007 by Representative Mike Brown allows vendors to retain three percent of sales taxes for goods that were made in the United States. This bill was voted from subcommittee as substituted on 2-7-13.
House Bill 1023 by Representative Randy McDaniel modifies the Employment Security Act of 1980; strikes unfair treatment as good cause to leave employment; modifies discharge for misconduct. This bill was voted from House Committee on House Economic Development and Financial Services on 2-27-13 as amended. House Bill 1052 by Representative Eric Proctor makes companies that outsource their labor ineligible from receiving incentive payments pursuant to the provisions of the Oklahoma Quality Jobs Program. This bill was voted from subcommittee as amended on 2-7-13. House Bill 1354 by Representative Marian Cooksey providing that an employee discharged for refusal to take a drug or alcohol test, or for a positive test result, shall be considered discharged for misconduct for purposes of unemployment compensation benefits. Shannon modifies conditions for unemployment; modifies discharge for misconduct and places burden of proof upon applicant; changes policy regarding employees terminated for refusing to take a drug test. Senate Bill 5 by Senator Gary Stanislawski amends statue regarding individuals employed by temp agencies; creates and defines obligations for temp agency employees and explains how they affect unemployment. Senate Bill 60 by Senator Harry Coates prohibits employers from discriminating between employees on the basis of sex by paying lower wages because of a difference in gender in comparable jobs; establishes punishments for noncompliance. Senate Bill 95 by Senator John Sparks creates an income tax exception for amounts received as overtime compensation; to go into effect after December 31, 2013. This bill was referred to Senate Committee Finance and is now DEAD as of 2-26-13. Senate Bill 229 by Senator David Holt adds that a charter school may be sponsored by the governing body of a city. This bill was referred to Senate Committee Education and is now DEADas of 2-26-13. Senate Bill 230 by Senator David Holt redefines “support employee” as employed by a school district; relates to causes of action for suspension, demotion, termination, or nonemployment of support employees and right of hearing. This bill was voted from Senate Committee Education on 2-25-13. Senate Bill 327 by Senator David Holt repeals sections of law relating to employment protection for smokers. This bill was voted from committee on 2-11-13. Senate Bill 361 by Senator AJ Griffin removes reference to support employees in due process hearings; removes the restriction of having conducted or presided over a due process hearing for attorneys representing school districts or administrations. This bill was voted from Senate Committee Education on 2-18-13 as amended. Senate Bill 396 by Senator Clark Jolley transfers all powers and duties of the Human Rights Commission to the Attorney General. This bill was voted from the Senate on 2-28-13 as substitutedwith a vote of 45 to 0. Senate Bill 407 by Senator David Holt removes certain notice and procedural processes for arbitration; removes authority to present certain bargaining offers to vote of the people; Removes special elections. This bill is DEAD as of 2-26-13. Senate Bill 417 by Senator Dan Newberry creates the Uniform Building Code Commission Act; Construction Industries Board will have staggered terms; added commission will have the power to establish training and certification for residential and commercial inspectors. This bill was heard in Senate Committee Business and Commerce on 2-7-13 and laid over and is now DEAD as of 2-26-13. Senate Bill 462 by Senator Jabar Shumate removes the requirement that employees notify their employers of their intention to vote in order to receive time off to vote. This bill was voted from Senate Committee Rules on 2-20-13 as amended. Senate Bill 519 by Senator Rob Standridge necessitates contractors bidding on public construction to submit credentials and identification numbers to the Oklahoma Tax Commission for verification and permits penalties for violations. This bill was voted from Senate Committee Finance on 2-21-13as substituted. Senate Bill 597 by Senator David Holt clarifies the state in for State Charitable Campaign.
