Per our email discussions about awarded grievances being paid after September 2012 but not being matched to the members 401(k) contributions. The Local 514 Executive Board and I are all in agreement that an International Grievance should be filed on behalf of all TWU members if this is determined to be a system issue. As you stated Jim Weel said it would be resolved going forward. To me that is an admission that it was incorrect in the past.
I ask that you take a look at Article 40, page 205 of the M&R contract. The very top paragraph states “Eligible compensation for the purpose of determining any matching contributions or company contribution, eligible compensation will be the sum of all 401(k) deferrable compensation, e.g. wages, overtime, CSW, etc.
We have grievances getting paid now that are two years old (Feb. 2, 2013).They did receive their 401k match. We know we have grievances that were previously settled after Sept. 2012 that did not receive 401k match. Those members are harmed. I’m hopeful that if this is a system wide problem you could file an International grievance and get it moved to the front of the docket.
Please advise as soon as possible. We will file a 29d for our members if it is not deemed a system issue. I don’t believe the company will want to arbitrate this issue. I believe its a win for our membership if we just get a grievance filed.
